Smuuv Social Media Sweepstakes
Full official rules and requirements (“Rules”)
- Organizer
The giveaway (the "Sweepstakes") is operated by Smuuv Body LLC (“Smuuv”, “Smuuv Body”, “Us”, “Our” and “We”).
- Rules
The following Rules apply to the Sweepstakes and are in addition to the terms and conditions contained by Our Privacy Policy and Terms of Service. Please read these Rules carefully. By participating in the Sweepstakes, You have affirmatively reviewed, accepted, and agreed to all of the Rules. The Sweepstakes is subject to all applicable federal, state and local laws and regulations. By participating, you (the “Entrant" or “You”) agree to these rules. You represent and warrant that You meet the eligibility requirements and accept Smuuv’s decisions as final and binding. Any questions, comments or issues related to the Sweepstakes should be directed to Smuuv.
- Entry Period
The Sweepstakes begins and ends on the dates (the “Entry Period”) determined under the Sweepstakes post on Smuuv’s social media channels (the “Post”). Entries submitted before or after the Entry Period will not be eligible.
- Prizes
The winner(s) of the Sweepstakes (the "Winner(s)") will receive the prize determined in the Post.
- Eligibility
The Sweepstakes is only open to those who are at least 18 years of age on the entry date and are resident of a country in which Smuuv products are sold and shipped to. Employees, independent contractors, interns, officers, directors, and agents of Smuuv their respective affiliates, subsidiaries, advertising and promotion agencies, suppliers and their immediate family members and/or those living in the same household of each are not eligible to participate in the Sweepstakes. Entries must meet all Sweepstakes Rules to be eligible to win a prize. Smuuv reserves the right to verify the eligibility of the Entrant.
- How to Enter
Enter the Sweepstakes by following the instructions under the Post. Entries must meet all Rules to be eligible to win a prize. Incomplete entries or those that do not adhere to the Rules may be disqualified at the sole discretion of Smuuv. You must provide the information requested. Multiple entries or attempts to enter through multiple email addresses, identities, or devices are prohibited and may result in disqualification.
- Odds of Winning
The odds of winning depend on the eligible entries received.
- Jury
A jury of 2 people from Smuuv’s Social Media team (the “Jury”) will give each entry a score based on the originality of the answer (the “Score”) to Smuuv’s aforementioned question under the Post.
- Winner Selection and Notification
Winners are selected based on the Score. Winners will be notified via direct message on social media within three (3) days after the Sweepstakes closes. If the Winner cannot be contacted or is ineligible, the prize may be forfeited and an alternate Winner selected. Smuuv shall have no liability for a Winner's failure to receive notices due to spam, junk e-mail, or other security settings, or for a Winner’s provision of incorrect or non-functioning contact information. Receipt of the prize offered in these Sweepstakes by the Winner is conditioned upon compliance with any and all applicable laws and regulations. Any violation of these Rules by the Winner, as determined in Smuuv’s sole discretion, will result in the Winner's disqualification, and all privileges as a winner will be immediately terminated.
- Shipment Prize
The Winner will indicate the delivery address within three (3) days after the notification by Smuuv. The Prize will be shipped within five (5) days after the delivery address is known by Smuuv. Receipt of the Prize offered in the Sweepstakes by the Winner is conditioned upon compliance with any and all federal, state, and local laws and regulations.
- Disqualification
Smuuv reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Sweepstakes or website, or violates these Rules. Smuuv has the right to maintain the integrity of the Sweepstakes, to void entries for any reason, including, but not limited to multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by the Sweepstakes rules; or the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website of Smuuv or undermine the legitimate operation of the Sweepstakes, may be a violation of criminal and civil laws. Should such an attempt be made, Smuuv reserves the right to seek damages to the fullest extent permitted by law.
- Limitation of Liability
By entering the Sweepstakes, You agree to release and hold harmless Smuuv and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant’s participation in the Sweepstakes and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) unauthorised human intervention in any part of the Sweepstakes; (iii) electronic or human error in the administration of the Sweepstakes or the processing of entries; (iv) technical errors of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (v) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (vi) printing errors; (vii) lost, late, postage due, misdirected, or undeliverable mail. Smuuv will not be liable for any damages or losses as a result of failure by Us to deliver the Prize as a result of any circumstances outside of Our direct and reasonable control including, but not limited to, as a result of a server failure (including but not limited to access delays or interruptions, data non-delivery or mis-delivery), any act(s) of God, war or terrorism, breaches of security or unauthorised use of personal data arising from hacking and/or failure or lack of reception of telephone or mobile telephone networks.
- Modification of Rules
Smuuv reserves the right to cancel, terminate, modify or suspend the Sweepstakes should virus, bug, non-authorised human intervention, fraud, or other cause beyond the Smuuv’s control corrupt or affect the administration, security, fairness, or proper conduct of the Sweepstakes. In such cases, Smuuv may select a winner from eligible entries received before and/or after the action taken by Smuuv.
- Disputes
This Sweepstakes is governed by the laws of the United States, without respect to conflict of law doctrines. Disputes shall be resolved individually, without resort to any form of class action, and exclusively by the courts of the United States. Participants waive the right to claim any damages beyond out-of-pocket expenses.
- Winner Announcement
To request a copy of the winners list please contact Smuuv. Requests must be sent within two (2) weeks of the end of the Entry Period.
- Odds of Winning
The odds of winning depend on the eligible entries received.
The Sweepstakes is in no way sponsored, endorsed, administered by, or associated with any social media platforms where it may be shared. You understand that You are providing your information to Smuuv and not to social networks.
By submitting Your personal details, You agree to Smuuv processing those details for the purpose of the Sweepstakes (including announcement of the Winner) and in accordance with Smuuv’s privacy policy which can be viewed at https://www.smuuvbody.com/policies/privacy-policy. By entering this Sweepstakes, You will receive additional product announcements, promotions and updates regarding the products of Smuuv. You can unsubscribe at any time and free of charge.
Smuuv reserves the right to alter, suspend or cancel the Sweepstakes in any jurisdiction if it is forced to do so due to illegality or invalidity of the Sweepstakes or due to binding self-regulatory rules, without any right of compensation towards the contestants.
